Terms and Conditions
1. Agreement
1.1 This is an Agreement between the hirer (You) and Arya Campervans Limited (ACL)
to rent the ACL’s vehicles. It includes details about rights, obligations, fees and liabilities associated with the rental.
1.2 This Agreement is governed by the laws of New Zealand. Any dispute arising from this Agreement will be resolved in accordance with New Zealand law.
1.3 By agreeing to this agreement you take full ownership and responsibility of the vehicle during the rental period..
2. Driver and license requirement
2.1 All drivers of any ACL vehicle must be at least 18 years old and hold a full and valid
driver’s license.
2.2 Drivers must hold a license in english, or an accredited translation.
2.3 Drivers must comply with their provisions of their license.
2.4 All potential drivers must show their valid drivers license(s) at collection and must submit a digital copy no later than seven days prior to the collection date.
2.5 Drivers must have no prior or pending charges for a driving related offence under the influence of alcohol or drugs.
2.6 Only the Driver(s) who signed the Vehicle Rental Contract may drive the vehicle.
3. Privacy
3.1 We collect, store, and process personal information strictly for purposes related to
the rental and operation of the vehicle. We undertake reasonable measures to safeguard such information from unauthorized access, use, or disclosure. Personal information may be disclosed to third parties solely for the purpose of recovering outstanding debts incurred during the rental period or as otherwise required by applicable law.
3.2 You have the right to access the personal information we hold about you and to
request corrections where necessary.
4. Vehicle Condition Collection and Return
4.1 You acknowledge that:

- The Vehicle is Sole property of ACL.
-
- You inspected the vehicle before the commencement of the rental and deemed it to be fit for the purpose you required it for.

- You agree to return the vehicle in the same condition it was before the commencement of the rental, except for ordinary wear and tear, subject to the Vehicle Condition Report, with all equipment, tools, and objects to the Return Location at the agreed return date and time.

- You and ACL both conducted your own Vehicle Condition Report and agreed on everything inside ACL’s Vehicle Condition Report.
4.2 You must return the Vehicle to ACL on the agreed date and time. If you need to alter
the return date and time you must inform ACL at least 24 hours in advance.
(a) If ACL agrees with your request you may continue renting the vehicle at the normal daily rate.
(b) If ACL decline your request you must pay for a late fee of $150 per day on top of the normal daily rate.
4.3 If You fail to return the vehicle to the right location, You must pay for all costs
associated with bringing the vehicle back including a $300 administration fee.
4.4 If You return the vehicle after the vehicle return time and ACL is no longer in working
hours. The vehicle will be considered returned at the time ACL opens next and subject to clause 3.2 of this Agreement.
4.5 The vehicle must be returned in a clean and orderly condition. If it is excessively
dirty, a cleaning fee of $150 may be applied. This includes, but is not limited to,
the presence of old food, sand, or mud inside the vehicle, as well as excessive hardened mud or road debris on the exterior. ACL reserves the right to determine whether a cleaning fee is necessary.
4.6 The vehicle will be provided with a full tank of fuel, and must be returned with a full
tank of fuel. The hirer will be in charge of paying the cost to get a full tank.
4.7 If a toilet is provided, upon returning the vehicle it must be sanitised, and the tanks
must be empty and cleaned. Failure to meet these requirements will result in a $200 cleaning fee.
4.8 In the case the vehicle is returned early, no refund of any fee(s) will be provided.
5. Your Responsibilities
5.1 The following things are prohibited in the vehicle and will result in a $300 fee.

- Smoking inside the vehicle.
-
- Animals inside the vehicle.
5.2 Driving the vehicle under the influence of any alcohol or drug is strictly prohibited.
5.3 Driving the vehicle for any illegal activity is strictly prohibited.
5.4 Maintain and check the oil and coolant levels every 500 kilometres, and Inform Arya
Campervans if it has been topped up.
5.5 Maintain tyres at the recommended pressure.
5.6 Keep the vehicle locked when it is not vacant and keep the keys on your person at
all times.
5.7 You are responsible for the contents of the vehicle and it’s safety until ACL has done
the post vehicle report.
6. Our duties
6.1 We will deliver the vehicle to you in a safe and roadworthy condition.
6.2 We will deliver the vehicle to you in a state as we deem clean.
6.3 We will take reasonable steps in providing you with a vehicle in the event of a
serious mechanical breakdown. Prone to the availability of a replacement
vehicle, the insurance of a replacement vehicle, and the location.
6.4 In the event of a serious mechanical breakdown, assuming you have adhered to these terms and conditions. If you are not able to use the vehicle, we will refund your hire fees for the remaining rental period from the day you first inform us.
6.5 We make every effort to resolve issues promptly, including lost keys, fridge malfunctions, water pump failures, cooker problems, battery issues, flat tires, damaged windscreens, heating breakdowns, electrical faults, or plumbing issues. However, any expenses you incur as a result such as accommodation, meals, alternative transport, or other related costs will be your responsibility.
6.6 If the terms and conditions are violated, we reserve the right to withhold any refunds in full.
7. Rental duration
7.1 Arya Campervans has minimal rental periods that may be adjusted from time to time. If the hirer requests a rental period shorter than the minimum amount, and ACL approves the daily rental period rate may be subject to change.
7.2 Rental fees are calculated per calendar day. The first rental day begins on the collection date, regardless of the time of collection, and the final rental day is counted on the return date, no matter when the vehicle is returned.
8. Cancellation and deposit
8.1 Once the full amount is paid for 30% is considered as the deposit. If a booking is cancelled at any time the deposit will not be refunded.
8.2 Arya Campervans retains the right to relist the vehicle if it is not picked up within 24 hours of the scheduled collection time, unless prior notice of a change in travel plans is given.
8.3 No refunds will be issued for late pick-ups or early returns.
8.4 In the event that Arya Campervans is unable to supply a vehicle due to unforeseen circumstances beyond its control, a credit will be issued for any unused rental fees.
9. No waiver of rights
9.1 Any delay or failure on our part to enforce a right, power, or remedy under this Agreement does not mean we have waived that right or any others. Similarly, if we exercise a right, power, or remedy only once or partially, it does not prevent us from using it again or enforcing any other rights in the future.
10. Revocation
10.1 ACL reserve the right to deny any rental, cancel this agreement, and reclaim the vehicle at any time if:

- You violate the terms of this agreement or provide false information in the vehicle rental agreement.

- The vehicle is not returned at the agreed date, or we have grounds to believe it will not be returned as scheduled.

- We determine the safety of passengers, the public, or the vehicle condition is at risk.
10.2 ACL reserves the right to terminate this agreement and take possession of the vehicle without prior demand to You, and at Your expense, if there has been a significant breach of ‘Arya Campervans Rental Agreement’.
11. Responsibility and legal obligations
11.1 You agree to promptly compensate us fir any loss or damage to the vehicle and related costs as outlined in this Agreement, except where liability falls on us or others under New Zealand Law.
11.2 You acknowledge that the use, operation, possession of the vehicle are at your own risk.
11.3 We are not responsible for any loss, damage, injury or death. Unless cause by our negligence.
11.4 To the fullest extent permitted by law, you release us, our agents, and employees from any liability, except in cases of negligence on our part.
11.5 Nothing in this Agreement removes, limits, or alters any non-excludable consumer rights under applicable legislation, including the Fair Trading Act in New Zealand.
12. Refunds
12.1 In the case that Arya Campervans issues a refund for any reason, the full amount owed will be credited to the Hirer in New Zealand Dollars. However, ACL is not responsible for any fees, such as banks or credit card providers charging for currency conversion or foreign transactions, that may reduce the refunded amount.
12.2 Any credit card surcharge applied to the initial payment will not be refunded.
12.3 If Arya Campervans approves a refund for any reason, it reserves the right to process the refund only after the camper has been returned by the Hirer.
13. Road User Charges
13.1 By New Zealand Law every diesel vehicle must pay road user charges. If ACL rents out a diesel vehicle then the fee is payable by the Hirer.
13.2 The fee per kilometre will be stated in the Vehicle Rental Agreement.
13.3 The Road User Charges the Hirer must pay will be calculated per every kilometre travelled during the hire.
14. Obligations
14.1 By agreeing to these terms and conditions, You are responsible for any infringement notice issued during the rental period, including but not limited to, any traffic and speeding violations.
14.2 A administration fee of $30 will also be payable to ACL as the administration fee.
14.3 During the rental period, you are also responsible for:
(a) The full cost of replacing or repairing any lost or damaged items supplied with
the vehicle, including but not limited to cookers, bedding, cutlery, tables, chairs,
tents, roof racks, roof boxes, rooftop tents, canopies, power cords, keys, and any
other additional equipment provided by Arya Campervans.
(b) Towing or salvage costs, except in cases of major mechanical failure.
15. Vehicle Accidents
15.1 In the case that You are involved in an accident which has caused damage to the vehicle, a third party, or person. You must contact us immediately, within the first 24 hours.
15.2 You will be responsible for any excess fee resulting from the accident.
15.3 Your liability for damage applies to each individual accident, incident, or occurrence of new damage.
15.4 In the case that the vehicle is damaged, breaks down, or requirs any repair, you must notify Arya Campervans within the first 24 hours. ACL will take reasonable step to correct the issues during the rental period. Failure to do so may affect any claim on insurance or compensation.
16. Vehicle Issues
16.1 You must notify us of any issues with the vehicle or equipment so we can take the reasonable steps forward to resolve this issue.
16.2 You must not operate, carry out or authorise any repairs without prior approval. Except when replacing a spar tyre
16.3 You are responsible for all call out fees, regardless of insurance, unless otherwise agreed by us.
17. Vehicle Insurance
17.1 To insure yourself for your liability for damage to the vehicle, you will be provided a full comprehensive insurance, the fee will be outlined in the ‘Vehicle Rental Agreement
17.2 ACL’s Insurance cover will cover;
-
- Fire,
-
- the vehicle or a conveying vehicle overturning,
-
- the vehicle suffering an impact or collision with an external object,
-
- the vehicle being partly or fully immersed in a body of water,
-
- the vehicle being stolen or converted,
-
- the vehicle being maliciously damaged by non-electronic means,
-
- the vehicle being accidentally operated with the incorrect fuel type, including but not limited to diesel in a petrol engine or petrol in a diesel engine. This does not include operating the vehicle with fuel of the correct type which is contaminated,
-
- hail, snow, storm or lightning,
-
- earthquake, subterranean fire, hydrothermal activity, geothermal activity, volcanic activity, or tsunami,
-
- impact or damage by animals.
17.3 The hirer is responsible for any and all excess required by ACL’s Insurance cover.
18. Exclusions from Insurance
18.1 The following parts are excluded from the insurance, in the event they are damaged by the hirer.
-
- engine and all engine parts,
-
- cooling systems, including but not limited to radiators, heat exchangers, cooling fans, pressure caps, water pumps, thermostats and hoses,
-
- hydraulic system, including but not limited to shock absorbers and suspension systems,
-
- transmission system, including but not limited to gearbox, drive shafts, axles, differentials, clutches, and wheel hubs,
-
- fuel systems,
-
- braking systems,
-
- electrical/electronic systems, computer systems, and mechanical systems,
-
- pumping and vacuuming systems,
-
- any fixed plant machinery (including but not limited to food /drink preparation equipment),
-
- underground exploratory devices.
19. Definition
19.1 ACL means Arya Campervans Limited.
19.2 Vehicle rental Agreement is the Agreement signed by the Hirer and ACL which includes a report of the vehicles condition at the time of collection which include but is not limited to; the vehicles odometer, existing damages, dents, equipment provided, bedding provided.
19.3 Hirer means the person hiring the vehicle for the Rental Period.
19.4 Vehicle means the vehicle identified in the Vehicle Rental agreement, including its
accessories.
19.5 You, Your, means the individual or entity renting the vehicle.
19.6 Rental Period means the period of time between the collection date and return
date.
19.7 $, Dollars, are all New Zealand Dollars, unless otherwise stated.
